Like if the life of the unemployed isn’t already frustrating with the soul-crushing job hunt, I recently received a letter from the Arbeitslosenversicherung in which they say I’m being penalized for 5 days for not uploading the results of this mandatory test: https://www.zh.ch/de/wirtschaft-arbeit/stellensuche-arbeitslosigkeit/anmeldung-rav-arbeitslosenkasse/pflichtinformationen-fuer-stellensuchende.html Some of the facts: I did complete the test before my RAV appointment and well within the deadline. I PDF printed the results and saved it on my PC. In the PDF, it’s clearly stated the date and time of completion of the test. When uploading all the documents required by RAV on the job-room portal, which are a lot btw, I didn’t find any item description in the dropdown menu that would fit the test results PDF I had to upload, so I decided to give priority to other documents I had to upload and deal with it later. To be fair, there is a “other documents” item in that menu, but for some reason, I didn’t think it was the best choice. The day of my first appointment with my advisor, she adds more stuff I need to upload to the document section. After the meeting, she proceeded to send me an email with 9 pdf attached to it, one of which had a list of documents I needed to upload, and among them the infamous test results PDF. The same day, I sent her a follow-up email, listing all the documents I’ve uploaded and asking her to let me know if I forgot anything. She replies by asking me to provide something else, but no mention of the missing test results pdf. Obviously, I tried to reason with these people over the phone without luck. The case specialist at Arbeitslosenversicherung had a native level of English, but refused to further speak to me in English. My RAV advisor showed no empathy or compassion whatsoever and reminded me that it was my duty to upload the test results on the portal as per her email with the 9 attached pdfs. To add insult to injury, it’s been a month and a half since I enrolled in RAV, and I haven’t received any money yet because they are still processing my application. So, somehow, they are pretty quick at taking money away, but when it comes to paying, they sure take their sweet time. Now, I have 30 days to appeal this unjust decision, and I need your help to understand how to draft a compelling case. Do I include the email exchange in which I ask my advisor if I forgot anything and she doesn’t mention it? I see a potential risk in doing this, as RAV advisors are supposed to speak in German and I’m calling her out by showing we communicate in English. As a consequence, my advisor could refuse to speak English in our future meetings or just decide to make my life hell as a form of retaliation. Also, does anyone have experience in dealing with these appeals? What are my odds? It really crushes my soul that for not uploading a stupid pdf for a test I did indeed take, they decided to take almost 25% of my RAV monthly salary. Thanks in advance! submitted by /u/balluppo
