Hi everyone, We are trying to leave our apartment in Fribourg, and we would appreciate any advice. We found two international master’s students (non-EU) who want to take over the lease. Both have full scholarships covering their living costs; however, they have bank accounts in their native countries, not in a Swiss bank. When they first applied, they didn’t have their Swiss residence permits yet, so their file was incomplete. The agency then asked them to provide a Swiss guarantor. They found one and sent the updated documents, but at that point they still didn’t have their residence permits, so the files were incomplete again. Yesterday they finally received their permits. This morning the agency told us their application had been refused, without giving any reason. We asked whether they could reapply now that their file is complete, with permits, scholarship confirmation and a Swiss guarantor. The agency answered that the file was “directly refused by the owner” and that a new submission is not possible. Since the main problem may most likely be the missing permits and then further documents (Swiss caution, liability insurance), it seems unfair that they can’t reapply now that everything is complete. Is there a way to challenge this? Can we formally propose them again as replacement tenants with the complete file attached, even though the agency says no? Does the landlord have to give a valid reason for refusing candidates who have a guarantor? I want to add that we really wanted and worked with them to ensure they actually collected everything before sending it, but due to the language barrier and their lack of knowledge of Swiss procedures and since they wanted to send documents by themselves, we are finding them hard to deal with, and they don’t follow basic instructions and expected procedures.
